On nearly the four-year anniversary of his arrest, Harry Goularte will go to trial in Santa Clara County (Calif.) court.
After years of legal proceedings, the defense and prosecution came to an agreement for a March 9 trial start date, which was approved by judge Benjamin Williams at a trial setting hearing Monday in San Jose.
Goularte is accused of molesting the then-four-year-old son of former UFC heavyweight champion Cain Velasquez at a daycare run by Goularte’s mother. He faces one felony charge of lewd acts with a minor under 14 years old, to which he pleaded not guilty.
Shortly after his February 2022 arrest, Goularte was released on conditions of GPS monitoring. On his way to get the ankle monitor, he and his family were chased by Velasquez in a high-speed car chase. During the chase, Velasquez fired several shots at the Goulartes’ vehicle and struck Goularte’s stepfather Paul Bender in the arm.
Velasquez was arrested on a litany of charges, including attempted murder. He spent nearly nine months behind bars before a judge granted him $50,000 bail. Velasquez initially pleaded not guilty, but switched his plea to no contest. In March, Velasquez was sentenced to five years in prison with time served. He is expected to be released prior to the trial start, with his attorney categorizing him as a “necessary witness” during Wednesday’s trial setting.
Restitution in Velasquez’s criminal case is still ongoing. Civil lawsuits have been filed by each party against the other.
